Connecticut Supreme Court affirms judgment in favor of DDN client in vexatious litigation action
DDN represented a major Connecticut law firm in a vexatious litigation action. A $3 Million suit was filed against the law firm, following the entry of summary judgment in favor of the defendant in the underlying litigation on statute of limitations grounds. At trial we were successful in obtaining a judgment in favor of the law firm, despite the fact that lawyers of the law firm knew the statute of limitations had run prior to filing the underlying suit. The argument accepted in the trial court was that there were tolling doctrines which made the claim non-frivolous, despite the fact that summary judgment had entered against the law firm in the underlying action. Both the Appellate Court and the Supreme Court agreed with our position.
